These Terms govern your use of www.franrealtor.com (the "Site"), operated by Francine Vieira, a licensed Florida real estate professional (License #3421634), acting through XDWell Real Estate, [ENDEREÇO DA CORRETORA].

By using the Site, you accept these Terms. If you do not accept them, please do not use the Site.

1. Informational Purpose Only

The Site is provided for general informational purposes. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any property, security, or investment.

Property descriptions, prices, availability, floor plans, renderings, amenities, projected completion dates, and developer information are subject to change without notice and are not guaranteed.

2. Listing Information

Listing data displayed on the Site is provided through Multiple Listing Service (MLS) feeds and is subject to the rules of the applicable MLS.

This information is provided exclusively for consumers' personal, non-commercial use, and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Information is deemed reliable but is not guaranteed. Some listings may be excluded from the Site. Listings held by brokerage firms other than the office owning this Site are marked in accordance with MLS rules.

You should independently verify all information that matters to your decision, including square footage, taxes, association fees, assessments, rental restrictions, and permitted use.

3. No Agency Relationship

Using the Site, submitting a form, registering to search listings, or exchanging messages with us does not create a real estate brokerage relationship, agency relationship, or fiduciary duty.

Under Florida law, a brokerage relationship is established only through the applicable written disclosure and agreement. Until such an agreement is in place, we are not acting as your agent, and you should not share confidential negotiating information.

4. No Legal, Tax, Financial, or Appraisal Advice

We are not attorneys, accountants, tax advisors, financial advisors, or state-certified appraisers, and nothing on the Site constitutes legal, tax, financial, immigration, or appraisal advice.

Any market commentary, comparative market analysis, value estimate, return projection, or investment discussion is an opinion based on available market data. It is not a formal appraisal, is not a guarantee of value or performance, and should not be relied upon as one.

Real estate values can decline as well as rise. Past performance of any market or development does not predict future results. Before purchasing, you should consult your own attorney, accountant, and tax advisor — in both the United States and your country of residence, if you reside outside the United States.

5. Mortgage and Financing

Financing is not a service provided by the real estate brokerage. We do not originate loans, make credit decisions, quote rates, or approve financing.

Where helpful, we can refer you to a licensed Mortgage Loan Originator (MLO) who will evaluate your profile independently. Any financing material on the Site is explanatory only. All loan terms, rates, down payment requirements, and approval decisions are determined solely by the lender, based on the property, the appraisal, and your profile, and are subject to change.

6. Fair Housing

We comply with the Federal Fair Housing Act, the Florida Fair Housing Act, and all applicable equal opportunity housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, or any other protected characteristic.

7. Third-Party Links and Content

The Site may link to third-party websites, developer materials, and external resources. We do not control that content and are not responsible for its accuracy, availability, or practices. A link is not an endorsement.

8. Intellectual Property

Text, graphics, logos, guides, and other content created by us are our property or used with permission, and may not be copied, republished, or used commercially without written consent. Photography and renderings supplied by developers or licensors remain the property of their owners.

9. Your Use of the Site

You agree not to:

• Scrape, harvest, or systematically extract listing data
• Use the Site or its content for any commercial purpose other than your own personal property search
• Interfere with the operation or security of the Site
• Submit false information or another person's contact details

10. Limitation of Liability

The Site is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or reliance on its content, including decisions made on the basis of listing data, market information, or illustrative financial examples.

11. Wire Fraud Warning

Wire fraud targeting real estate transactions is common and costly. We will never send wiring instructions, or changes to wiring instructions, by email.

If you receive any email containing wiring instructions or account details that appears to come from us, from a title company, or from a closing agent, do not act on it. Call using a telephone number you have independently verified before transferring any funds.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.

13. Changes

We may update these Terms at any time. The "Last updated" date above reflects the most recent version. Continued use of the Site after changes are posted constitutes acceptance.
